1. Acceptance of Terms

MarineTech Balearics ("the Service") is operated by Fusion Metrics Inc. and accessible at marinetech.es. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MarineTech Balearics is an online directory platform that connects boat owners and sailors with marine service providers across the Balearic Islands (Mallorca, Menorca, Ibiza, and Formentera). The Service allows users to search for marine services, read and write reviews, and allows businesses to create and manage their listings. MarineTech acts as an intermediary platform and is not itself a provider of marine services.

Your use of the Service is also subject to our Privacy Policy, which explains how we process personal data in accordance with the GDPR.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that appear to contain false or misleading information.

4. Business Listings

Business owners who create listings on MarineTech represent and warrant that:

• They are authorized to represent the business listed.
• All information provided is accurate and up to date.
• They will update their listing promptly when information changes.
• Their business complies with all applicable laws and regulations.

MarineTech does not verify, endorse, or guarantee the accuracy of any business listing. We do not guarantee the quality, safety, or legality of any listed service. Users engage with listed businesses at their own risk and should conduct their own due diligence.

5. Reviews and User Content

By submitting reviews, ratings, or other content to MarineTech, you agree that:

• Your review reflects your honest, genuine experience with the business.
• You will not post false, misleading, or defamatory content.
• You will not post content that is abusive, threatening, discriminatory, or otherwise objectionable.
• You will not post spam, promotional content for competing services, or irrelevant material.
• You grant MarineTech a non-exclusive, royalty-free, worldwide license to use, display, and distribute your submitted content on the platform.

MarineTech reserves the right to remove, edit, or refuse to publish any review or content that violates these Terms, without prior notice. We do not pre-screen all user content, but may monitor submissions for compliance.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or misrepresent your affiliation.
• Scrape, harvest, or collect data from the platform without permission.
• Interfere with or disrupt the Service or its infrastructure.
• Transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to any part of the Service.

7. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by MarineTech Balearics and are protected by international copyright, trademark, and other intellectual property laws. The MarineTech name, logo, and related marks are trademarks of MarineTech Balearics. You may not use our trademarks without prior written consent.

8. Limitation of Liability

Subject to the carve-outs below and to the fullest extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• MarineTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• MarineTech is not responsible for any transactions, agreements, or disputes between users and listed businesses.
• Our total liability for any claim arising out of these Terms shall not exceed the amount you have paid to MarineTech in the twelve months preceding the claim, or EUR 100, whichever is greater.

Consumer carve-outs. Nothing in this section excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or wilful misconduct; (iv) any other liability which cannot be excluded or limited under Spanish or EU consumer law. Your statutory consumer rights remain unaffected.

9. Indemnification

If you are using the Service other than as a consumer (for example, as a business listing owner acting in a commercial capacity), you agree to indemnify and hold harmless MarineTech Balearics and Fusion Metrics Inc., their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your commercial use of the Service, your violation of these Terms, or your violation of any rights of a third party.

This clause does not apply to you in your capacity as a consumer under applicable EU or national law.

10. Governing Law & Dispute Resolution

These Terms are governed by Spanish law. Commercial disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of the Balearic Islands, Spain.

For consumers: the choice of law and forum above does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you are habitually resident (Regulation (EC) No 593/2008 "Rome I", Art. 6). You may bring proceedings in your country of residence or in Spain, at your option.

Online Dispute Resolution (ODR): pursuant to EU Regulation 524/2013, the European Commission provides an online platform for the resolution of consumer disputes: ec.europa.eu/consumers/odr. You may also contact us first at info@marinetech.es — we prefer to resolve issues directly where possible.

11. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated by updating the "Last updated" date on this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
